租赁汽车者需承担的责任

承租人承租车辆的正常维修、保养、年审和保险由租赁公司负责。因承租人延误车辆的保养或年审，由此造成的损失由承租人负全部责任。在租赁期内，承租人要按《车辆使用手册》操作及保养。在出车前，必须作常规检查，如机油、刹车油、冷凝水、轮胎气压和灯光等，若发现问题，须速送租赁公司指定的维修点维修，否则后果自负。承租人在租赁期内，有义务妥善保管好，使用好所租用的汽车及其有关的证件，保持车身清洁直到归还租赁公司为止。如有遗失应即时通知租赁公司及有关部门。

　　
承租人在租赁期内，不允许有损害本公司租赁汽车所有权的行为。

1、对租赁的车辆不得转让、转租、销售、抵押及投资等任何侵犯租赁公司所有权行为。 　

2、不得将租赁的车辆进行营运、体育、军事、竞赛等，严禁装载易燃易爆或腐蚀物品。 　　

3、不得用租赁车辆进行任何违法乱纪活动。 　　

4、承租人因经营不善关闭、停产、被兼并或破产时，除租赁公司外，其他债权人元权处理租赁公司租出的车辆。

5、未经租赁公司书面同意，承租人不得改变所租车辆的车身颜色、形状，不得改装或加装车内结构。 　　

属承租人的责任人引致发生事故、损伤、死亡、遗失及被盗等时，承租人应向租赁公司如实报告并支持营业补偿费和损害赔偿金，规定如下：

　 1、车辆的证件及资料如有损缺、丢失，由承租人负全部责任和费用，同时还须承担自丢失证件之时起至补证完毕之日的全部租金。

2、承租人对发生事故的赔偿，承租人承担保险公司规定不予赔付的而实际需支出的费用，并承担因事故引起的刑事责任。

3、车辆被盗、被抢时，承租人要承担保险公司免赔部分的金额赔偿给本公司；承租人还须承担失车后至保险公司赔偿前该期间50%的租赁费用；办理索赔时承租人应向保险公司提交事故证明、事故调解结案书、损失清单和各种有关费用的单据，如实填写机动车出险报告单等证。

　　 发生事故后，承租作必须马上通知有关部门和租赁公司并保护好现场。承租人自行负担租赁车辆的燃油、过桥费、保管费等消耗费用。承租人在租车期间，租赁汽车发生事故时，无论事故大小，都要马上向租赁公司报告事故的情况，并提供有关所需的资料证据。

　 租赁车辆的修理如无特别的理由，要求在租赁公司指定的修理厂进行，否则，承租人按所拆零件价的2~3倍赔款，同时须归还所拆原零部件，而且必须承担由此而产生的一切责任。

　 租车期内，发现车辆异常或故障时应马上停止驾驶，并通知租赁公司。同时，还应遵从租赁公司的指示。

　 由于不可抗拒的灾害而造成租赁车辆的损失，承租人则应马上通知租赁公司并将汽车送到指定修理厂修理。
